UKPokerBuddies Terms and Conditions

Welcome to PokerBuddies, the service for poker players to meet each other online and find poker games and tournaments to attend operated by PokerBuddies Limited ("PokerBuddies" or "we" or "us"), a company registered in England and Wales (company number ). We want you to enjoy our services, please read the terms and conditions below to get the most out of your PokerBuddies experience.

Once you have completed your online registration your membership will be confirmed by email to the address that you have given and you have entered into a legally binding contract for the provision of the PokerBuddies service (the "Service").

1. Eligibility. You must be eighteen or over to register as a member of PokerBuddies or use the Website. Membership of the Service is invalid where it has been prohibited. By using the Website, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

2. Registration and Scope of Service. You may become a member of the Service at no cost. As a member you will have the ability to participate in some, but not all, of the features and services available within the Service. You man use the search facilities, create a blog, contact other members of the website and post poker related events. We reserve the right to start charging for membership in the future, should we decide to do this; you will have the opportunity to opt out of membership at such time as this arises.

3. Membership termination. You may terminate your membership at any time, for any reason, effective upon receipt by us of your written or email notice of termination. You may contact us by email at members@ukpokerbuddies.com.

4. Intellectual Property. Except for that information which is in the public domain you may not copy, modify, publish, transmit, distribute, perform, reproduce, license, create derivative works from, transfer display, or sell or re-sell any such intellectual property or proprietary information.

5. Content Posted on the Site and Prohibited Content.

You may not use the website to promote commercial services except as set out below under authorized commercial content or with our express written permission which can be obtained by emailing a request to members@ukpokerbuddies.com.

Permission is at no time guaranteed and promotion of services of a commercial nature may be removed from the website and membership terminated if you abuse the service.

Authorised commercial content:

• You may post the details of poker games, tournaments and events in our events calendar once per scheduled event.
• You may cover commercial events in your blog but we retain the right to edit and delete these posts if we feel you are abusing the service for any reason and at our discretion.
• You may suggest that we add a venue (casino or card room) to our venue listings. However, inclusion is not guaranteed and is at our discretion, please email the details and any relevant information to venues@ukpokerbuddies.com.

Do not post content which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of members.

• You are solely responsible for the Content that you publish, submit, post or display (hereinafter, "post") on the Service, or transmit to other members via the Service. You represent and warrant that at any time of posting the Content is (a) not in breach of this Agreement, and (b) not harmful to any person in any way.
• Content posted on the website by members at no time represents the views of PokerBuddies and may not be worded to imply as such.

You may not post content that:

• is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
• constitutes a profile or photographs of any third person used without their permission.
• harasses or advocates harassment of another person;
• involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
• promotes information that you know is false, misleading or promotes illegal activities or promotes conduct, or that is abusive, threatening, obscene, defamatory or libelous;
• engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes except as stated above.

7. Prohibited Activities. PokerBuddies reserves the right to investigate and terminate your membership if you have misused the Service, or behaved in a way which could be regarded as inappropriate or whose conduct is unlawful or illegal. The following is a partial list of the type of actions that you may not engage in with respect to the Service:

• You will not impersonate any person or entity.
• You will not "stalk" or otherwise harass any person.
• You will not express or imply that any statements you make are endorsed by PokerBuddies without our specific prior written consent.
• You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
• You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other intellectual property or proprietary information without obtaining the prior consent of the owner of such proprietary rights.
• You will not remove any copyright, trademark or other proprietary rights notices contained in the Service.
• You will not interfere with or disrupt the Services or the site or the servers or networks connected to the Services or the site.
• You will not post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
• You will not forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Service.
• You will not "frame" or "mirror" any part of the Service or the Website, without the prior written authorization of PokerBuddies Ltd. You also shall not use meta tags or code or other devices containing any reference to PokerBuddies or the Service or the site in order to direct any person to any other web site for any purpose.
• You will not transmit or post any material which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party in the UK or any other country in the world.
• Except and only to the extent permitted under applicable law, you will not modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service or the Website or any software used on or for the Service or cause others to do so.

8. Account Security. You are responsible for maintaining the confidentiality of the username and password that you designate during the registration process with the Service, and you are fully responsible for all activities that occur under your username and password.

9. Customer Service. PokerBuddies provides assistance and guidance through its members@ukpokerbuddies.com address only. When communicating with us you may not to be abusive, obscene, profane, offensive, sexist, threatening, harassing or racially offensive. If we feel that your behaviour towards any of our employees is at any time threatening or offensive, we reserve the right to immediately terminate your membership indefinitely.

10. Copyright Policy. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other intellectual property or proprietary information without obtaining the prior written consent of the owner of such proprietary rights whether that be PokerBuddies or a fellow member.

11. Access. While we endeavour to ensure that this Website is normally available 24 hours a day, we do not guarantee that it will be uninterrupted or error free. Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

12. Disclaimers. Material posted by members is at no time a reflection of the opinions of employees of PokerBuddies. We do not guarantee the accuracy or reliability of any advice, opinion, statement or other information displayed, uploaded or distributed through the Service by us, our partners or any member or any other person or entity. PokerBuddies are not responsible for any financial losses through poker play either on or offline as a result of advice from fellow members, published instructions or resident experts.

13. Modifications to this Agreement. We may alter or amend our terms and conditions upon giving reasonable notice in advance of such amendment taking effect. If upon receiving any notice, if you do not wish to continue with the Service, you may terminate the your membership upon giving us notice by email via members@ukpokerbuddies.com.

14. Ownership of rights. All materials on the Website are copyrighted and are protected under treaty provisions and world-wide copyright laws. All rights reserved.

15. Release. In the event that you have any claim or action against any other member arising from that member's use of our Website or the Service, you agree to pursue such claim or action independently of and without any demands from us, and you release us from all claims, liability and damages, arising from or in any way connected to the claim or action.

16. Offline member conduct and responsibilities. You are fully responsible for any poker games that you decide to host and your conduct at those that you attend. PokerBuddies will not be held responsible for the action of any member at a game or tournament and all players are advised to take sensible precautions when hosting their own games.
